Pacquiao’s fight vs Spence now in the hands of California judge

A California judge in Orange County is expected to rule on the petition of Paradigm Sports Management CEO Audie Attar to issue an injunction and stop the scheduled fight between Filipino senator Manny Pacquiao and American boxer Errol Spence, Jr. on August 21, 2021 in Las Vegas, Nevada anytime soon.

This loomed large after Judge Walter P. Schwarm of the Superior Court of California Division C19 held an ex-parte hearing on Wednesday, July 28, on Attar’s application for a temporary restraining order over Pacquiao’s alleged breach of contract.

Attar is asking for Pacquiao to return the $3.3 million advance he supposedly received upon signing the contract in October 2020 and damages arising from the injury to its reputation and loss of expected profits.

The case is docketed as Case Number 30-2021-01207553 entitled “Paradigm Sports Management versus Emmanuel Dapidran Pacquiao” for breach of contract/warranty.

An ex-parte hearing allows a Judge to hear and rule on a motion even without a response from the other party-litigant.

Pacquiao, through his American lawyer, had dismissed the lawsuit as “frivolous” intended only to interfere with his scheduled fight with Spence. He assured fans that the fight will proceed as scheduled and his lawyers are prepared to do battle in court.

Judge Schwarm is 57 years old with 12 years experience on the bench. A 1989 graduate of Juris Doctor (J.D.) from the California Western School of Law, he had worked as Deputy District Attorney, Sr. District Attorney and Assistant District Attorney for the Orange County District Attorney’s Office from 1989 to 2009. He was admitted to the California State Bar in 1989.

On July 16, 2009, he was appointed as Superior Court judge by California Governor Arnold Schwarzenegger.
